This Workshop is designed as an intensive, across-the-board training seminar for delegates now using or desiring to become familiar with the various EFET form agreements to buy and sell power, natural gas and carbon emissions rights throughout Europe, as well as to mitigate counterparty credit and performance risks through the optimal utilization of collateral annexes and master netting agreements. Specifically, the Workshop will focus on EFET’s efforts to standardize physical energy trading terms and improve industry risk mitigation through the widespread adoption of its standard form documents. Particular attention will also be given to various methods and mechanisms for managing legal, contracting and credit risk.
This Workshop will provide a comprehensive introduction for those new to the industry or EFET’s form documents. And for those already using the EFET Agreements, the Workshop will provide a chance to clarify issues and brush up on the nuts and bolts of each of the EFET form agreements in preparation for discussions with other professionals at the following day’s Legal Summit and Contracting Conference.
The Workshop will be presented by EFET’s outside general counsel, Mr. John Varholy of Troutman Sanders LLP, and by his colleague, Edward Clayman. Troutman Sanders LLP has been one of the principal architects of each of EFET’s standardized documents and several similar industry standard agreements used in North America. Mr. Varholy is the Managing Partner of the London offices of Troutman Sanders LLP.
The Workshop is targeted at and will greatly benefit energy trading lawyers (both in-house and in private practice), contracts administration managers, risk and credit managers and related personnel and all others who participate in the traded European energy markets whose commercial terms normally mirror those found in EFET’s form agreements.
By the end of the Workshop attendees will be familiar with the procedures, documents and issues involved with trading power and natural gas throughout Europe. In addition, attendees will know everything they need to start using (or for those already using, to better understand and master), each of:
- the EFET Electric Power Master Agreement (Version 2.1);
- the EFET Gas Master Agreement (Version 2.0);
- the EFET Credit Support Annex (Version 1);
- the EFET/IECA European Commodities Schedule (the "Schedule") (Version 1) to the Bond Market Association's Cross-Product Master Agreement ("CPMA");
- the EFET Cross-Product Credit Support Annex ("CPCSA") to the CPMA (Version 1); and
- the EFET Carbon Emissions Allowance Appendix (the "Allowance Appendix") (Version 2.0).
